1. Agreement to Terms
By accessing or using Leaflet, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use our services. Leaflet is operated from New Zealand, and these terms are governed by New Zealand law.
2. Description of Service
Leaflet provides a web-based platform for creating and managing leaflet distribution maps, routes, and campaigns. Our services include route optimisation, turn-by-turn instructions, volunteer management tools, and campaign analytics.
3. Account Registration
To use certain features of Leaflet, you must register for an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Promptly update your account information if it changes
- Accept responsibility for all activities that occur under your account
4. Acceptable Use
You agree not to use Leaflet to:
- Violate any applicable laws or regulations
- Infringe on the rights of others
- Distribute spam, malware, or other harmful content
- Attempt to gain unauthorised access to our systems or other users' accounts
- Interfere with or disrupt the integrity or performance of our services
- Use automated systems to access the service in a manner that exceeds reasonable use
5. Subscriptions and Payment
Some features of Leaflet require a paid subscription. By subscribing to a paid plan, you agree to pay the applicable fees as described on our pricing page. Subscription fees are billed in advance on a recurring basis. You may cancel your subscription at any time, and cancellation will take effect at the end of your current billing period.
We reserve the right to change our pricing with reasonable notice. Continued use of the service after a price change constitutes acceptance of the new pricing.
6. Intellectual Property
Leaflet and its original content, features, and functionality are owned by Leaflet and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of any data and content you upload to the service.
By uploading content to Leaflet, you grant us a limited licence to use, store, and process that content solely for the purpose of providing and improving our services.
7. Data and Privacy
Your use of Leaflet is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information in accordance with New Zealand's Privacy Act 2020.
8. Limitation of Liability
To the maximum extent permitted by New Zealand law, Leaflet shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, resulting from your use of or inability to use the service.
Nothing in these terms excludes or limits liability that cannot be excluded or limited under New Zealand law, including the Consumer Guarantees Act 1993 where applicable.
9. Disclaimer of Warranties
Leaflet is provided on an "as is" and "as available" basis. We make no warranties, expressed or implied, regarding the reliability, accuracy, or availability of the service. We do not guarantee that the service will be uninterrupted, secure, or error-free.
10. Termination
We may terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason, including if you breach these Terms of Service. Upon termination, your right to use the service will immediately cease. You may also delete your account at any time through your account settings.
11. Changes to Terms
We reserve the right to modify these terms at any time. We will provide notice of significant changes by posting the updated terms on this page and updating the "Last updated" date. Your continued use of Leaflet after changes are posted constitutes acceptance of the modified terms.
12. Governing Law
These terms shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of Leaflet shall be subject to the exclusive jurisdiction of the courts of New Zealand.
